Village Court Rule

Rule-1 (Short name and commencement) This Rule shall be called Rule-1 of the Village Court Rule of the Year. Rule-2 (In this Rule if there is nothing contrary to the content or context) (a) "Form" shall mean the form incorporated herein. (B) "Ordinance" shall mean the Village Court of 3 "Ordinance (Ordinance No. 8 of 3); (C) "fragment" shall mean any part of the schedule of the Ordinance; (D) "applicant" shall mean a person who makes any application pursuant to that section of the Ordinance; (E) "defendant" shall mean any person who makes any application against that section of the Ordinance; And (f) "Article" shall mean any section of the Ordinance. Rule-1: (1) An application must be made in writing under sub-section (1) of section 6 and it shall be signed by the applicant and submitted to the Chairman of the Union Council. (2) the application in accordance with sub-section (1) shall contain the following particulars; Namely: (a) the name of the union in which the application is made; (B) the name, identity and residence of the applicant; (C) the name, identity and residence of the defendant; (D) the name of the union in which the offense was committed or the cause of the complaint; (E) the nature of the complaint or claim and the facts thereof, with a brief description; And (f) all remedies to be sought. (4) In this rule, the application shall be filed with the petitioner for a fee of two rupees in respect of the first part of the schedule and four rupees in respect of the second part. Rule-1: When the Chairman of the Union Council shall reject the application pursuant to subsection (1) of section 6, the application shall be returned to the applicant with the order given thereon. Rule-1: (1) Within 5 days from the date of refusal, the application for revision shall be submitted to the Assistant Judge with the jurisdiction pursuant to sub-section (2). (2) The petition shall be in writing and signed by the plaintiff in accordance with sub-rule (1). It shall contain the names, particulars and addresses of the parties, and the original application which the Chairman of the Union Council has rejected and returned must be submitted along with this petition. In all the reasons for which revision is being applied, it must also be briefly mentioned in the petition. Rule-1: If the Assistant Judge who is to be petitioned pursuant to sub-section (2) of this section, holds that the order given by the Chairman of the Union Parishad is intentional or grossly unjust, he shall, in writing, request the Chairman to accept the application. Order the same and return it to the applicant with a similar order. Rule-1: (1) If the application is received, the particulars of the register shall be recorded in Form No. 1 and the number and year of the case registered in that register shall also be recorded on the application. (2) When a police magistrate or assistant judge returns a case for reconsideration under sub-section (2) of that section, it shall be re-enrolled in Form No. 5 and shall be heard as a new case. Rule-1: (1) After registering the application in accordance with Rule 3, the Chairman shall instruct the applicant to appear at a specified date and time and summon the defendant to appear at that specified date and time. (2) All sums given pursuant to this Rule shall be in writing and signed and sealed by the Chairman of the Union Council at two widths, and after the formation of the village court, the chairman of the village court shall be signed and sealed. (4) Except where otherwise provided, in each case, an employee of the summons of the Union Council or chairman of the Union Parishad or village court shall be issued by any person appointed for the purpose, as provided in this rule. (4) If the summoned person is summoned, if possible, the summons must be issued to the person personally by giving a sum of two widths summoned. (3) Every person on whom the summons is issued shall acknowledge receipt by signature on the opposite page of the other sum of the summons. (3) If, despite the best efforts, it is not possible to issue summons in the manner described above, then the employee who issued the summons shall hang a public summons of one open sum of the house where the summons recipient resides, and thereby the summons shall be deemed to have been duly issued. Shall be (3) If the person named in the summons, resides outside the jurisdiction of the Union Council, the chairman of the union council or village court may issue a summons by registration (with the cost of acknowledgment received) and the applicant will have to bear the costs. Rule-1: (1) The defendant must be summoned in Form 2. (2) The summons to the witness must be given in Form No.4. Rule-1: After the summons has been issued on the defendant, the chairman of the union council shall ask the parties to nominate their members within seven days, and likewise the village court shall be constituted with the nominated members and the chairman of the union council. Rule-1: After receiving the names of the members, the Chairman of the Union Parishad shall record the names of the members in a brief column of Form No. 7. Rule-12: (1) Where a village court decides a case, the chairman of the union council may at any time refuse to act as the chairman of a village court for any reason, as described in sub-section (2) of section 5, or a pak.
